Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Eynis website and platform (the “Service”). By accessing or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you agree on its behalf and represent that you have authority to do so.

1. The Service

Eynis provides an intelligence layer that connects to your existing systems to give you real-time visibility and operational insights. We may update, improve, or modify the Service over time. We may also add or remove features, and we will use reasonable efforts to notify you of material changes.

2. Accounts and access

• A license grants one named user login access to the Eynis dashboard.
• Licenses can be shared across shifts but not used simultaneously; each license is tied to one active session at a time.
• You are responsible for safeguarding your credentials and for all activity under your account.
• You must notify us promptly of any unauthorized use or security breach.

3. Acceptable use

You agree not to:

• Use the Service in violation of any applicable law or regulation.
• Attempt to gain unauthorized access to the Service or its related systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Reverse engineer or copy the Service except as permitted by law.
• Use the Service to store or transmit unlawful, infringing, or harmful content.

4. Customer data

You retain all rights to the data you connect to or process through the Service. You grant us a limited license to process that data solely to provide and support the Service. Our handling of personal data is described in our Privacy Policy. We do not sell your data and do not train shared AI models on it.

5. Fees and payment

Paid plans are billed according to the pricing and terms agreed at sign-up. Unless stated otherwise, fees are non-refundable and exclusive of applicable taxes. We may change pricing on a prospective basis with reasonable notice.

6. Trials and demos

Demo environments and promotional offers (including founding-customer terms) are provided as described at the time of the offer and may be modified or withdrawn. They are provided on an “as is” basis for evaluation purposes.

7. Intellectual property

The Service, including its software, design, and content, is owned by Eynis and its licensors and is protected by intellectual property laws. These Terms do not grant you any rights in the Service except the limited right to use it as described here.

8. Confidentiality

Each party may receive confidential information from the other. Both parties agree to protect such information and to use it only as necessary to perform under these Terms.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

10. Limitation of liability

To the maximum extent permitted by law, Eynis will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill. Our aggregate liability for any claim arising out of these Terms will not exceed the amounts you paid for the Service in the twelve months preceding the claim.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or if required to do so by law. Upon termination, your right to use the Service ends, and we will handle your data in accordance with our Privacy Policy and any applicable agreement.

12. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. The courts located in India will have exclusive jurisdiction over any disputes, unless otherwise agreed in a separate written agreement.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
